Conclusion
While there is much uncertainty, given the complexities of the political context in all three countries, it is reasonable to conclude that there is a particular risk of some kind of military confrontation in the six months to September. This is in spite of the many voices in the United States, Western Europe, and even Israel, that are calling for restraint. It is certainly likely to be
a time of considerable tension, and in such circumstances the so-called “AIM” factor becomes important – Accidents, Incidents and Mavericks. Any one of these factors might exacerbate a crisis, and this means that it is particularly important to work for an easing of the tensions. Ifthat happens and a conflict is avoided in the coming months, then there is a good chance that
negotiations in a calmer atmosphere next year might meet with success.

The question of Palestine is one of the oldest issues discussed within the United Nations. In 1947, the General Assembly resolution 181 (II) recommended the partition of the British Mandate between two states. Palestine's status has evolved over the years through several General Assembly resolutions:

  • 1974: resolution 3237 (XXIX) granting Palestine Liberation Organization observer status.
  • 1988: following the Proclamation of the State of Palestine, the General Assembly adopted two resolutions : resolutions 43/160 granting PLO the right to circulate communications without intermediaries and resolution 43/177 changing the designation of PLO to Palestine. 
  •  1998: resolution 52/250 granting Palestine additional rights, such as the right to participate in the General Debate.

Difficult Times for the Israeli Civil Society

The number of attacks by the nationalist camp against Israeli human rights organizations and other non-governmental organizations has risen significantly in the past six months. The work of these organizations has always been disputed by certain parts of the Israeli society. In a state which is in conflict with its neighbors – a conflict  that frequently adopts violent and warlike traits, such disputes is are to be expected. Furthermore, a non-negligible part of the actors considers the conflict as an existential one.

In the public self-conception, the majority of Israelis see their state as Jewish and democratic. Continually, people are talking about Israel as the only democracy in the Middle East. For quite a long time the right part of the political spectrum in Israel has the tendency to shift the inherent tension between “Jewish” and “democratic” in favor of the “Jewish” aspect. Former member of Knesset Geula Cohen got to the heart of it with the following statement: “We need less democratic hysteria and more Zionist historia!”.

When in February 2010 the Israeli human rights organization B’Tselem celebrated its 20th anniversary, some of the speakers remembered one of Yitzhak Rabin’s reasons for his decision to sign the Oslo accords: Yassir Arafat and the PLO were now able to deal with terrorists “without the High Court and B’Tselem”.

However, increased attacks on essential parts of Israeli civil society as they happened since 2009, above all as a consequence of the debates over the Gaza war in 2008/2009, are unequalled.

The United Nations Environment Programme (UNEP) has released Environmental Assessment of the Gaza Strip following the escalation of hostilities in December 2008 – January 2009 (pdf). This report examines the environmental situation in the Gaza Strip and provides recommendations for remediation of environmental damage caused by the recent escalation of hostilities. It identifies as a top priority the Gaza Strip's underground water supplies, which "are in danger of collapse as a result of years of over-use and contamination that have been exacerbated by the recent conflict" (news release).

This document outlines UNRWA’s updated emergency plans for Palestine refugees in Gaza during 2009. It replaces the Agency’s original Quick Response Plan to Restore Critical Services to Refugees in Gaza (pdf), which covered the period January – September 2009, and reflects funding needs until the end of this calendar year.

Gaza Crisis 2008 - 2009 : Office for the Coordination of Humanitarian Affairs in the Occupied Palestinian Territory This site was created by the OCHA office in the occupied Palestinian territory (oPt) to provide coverage of the worsening political and humanitarian situation in the region in 2008-9. It offers access to situation maps of Gaza, press releases and reports. HAMAS and Israel: Conflicting Strategies of Group-Based Politics

Efforts to separate HAMAS from its popular support and network of social and charitable organizations have not been effective in destroying the organization, nor in eradicating the will to resist among a fairly large segment of the Palestinian population. It is important to consider this Islamist movement in the context of a region-wide phenomenon of similar movements with local goals, which can be persuaded to relinquish violence or which could become more violent. Certainly an orientation to HAMAS and its base must be factored into new and more practical and effective approaches to peacemaking in the region. At the same time, HAMAS offers a fascinating glimpse of the dynamics of strategic reactions and the modification of Israeli impulses towards aggressive deterrence, as well as the evolution in the Islamist movements’ planning and operations. The Palestinian-Israeli conflict bears similarities to a long-standing civil conflict, even as it has sparked inter-Palestinian hostilities in its most recent phase.

After the first Gulf war, in 1991, a new peace process consisting of bilateral negotiations between Israel and the Palestinians, Jordan, Syria, and Lebanon achieved mixed results. Milestones included the Israeli-Palestine Liberation Organization (PLO) Declaration of Principles (DOP) of September 13, 1993, providing for Palestinian empowerment and some territorial control, the Israeli-Jordanian peace treaty of October 26, 1994, and the Interim Self-Rule in the West Bank or Oslo II accord of September 28, 1995, which led to the formation of the Palestinian Authority (PA) to govern the West Bank and Gaza Strip. However, Israeli-Syrian negotiations were intermittent and difficult, and postponed indefinitely in 2000. Negotiations with Lebanon also were unsuccessful, leading Israel to withdraw unilaterally from south Lebanon on May 24, 2000. President Clinton held a summit with Israeli and Palestinian leaders at Camp David on final status issues that July, but they did not produce an accord. A Palestinian uprising or intifadah began in September. On February 6, 2001, Ariel Sharon was elected Prime Minister of Israel, and rejected steps taken at Camp David and afterwards.

On April 30, 2003, the United States, the U.N., European Union, and Russia (known as the “Quartet”) presented a “Road Map” to Palestinian statehood. Neither Israel nor the Palestinians have implemented it. Israel unilaterally disengaged (withdrew) from the Gaza Strip and four small settlements in the West Bank in August 2005. On January 9, 2005, Mahmud Abbas was elected to succeed Yasir Arafat as President of the PA. The victory of Hamas, which Israel and the United States consider a terrorist group, in the January 2006 Palestinian parliamentary elections complicated prospects for peace because the United States, Israel, and the Quartet would not deal with a Hamas-led government until it disavowed violence, recognized Israel, and accepted prior Israeli-Palestinian accords. The June 2007 Hamas military takeover of the Gaza Strip and President Abbas’s dissolution of the Hamas-led government resulted in resumed international contacts with the PA. On November 27, President Bush convened an international conference in Annapolis, MD, and read a Joint Understanding reached by Abbas and Israeli Prime Minister Ehud Olmert, in which they agreed to simultaneously resume bilateral negotiations on core issues and implement the Road Map.

Congress is interested in issues related to Middle East peace because of its oversight role in the conduct of U.S. foreign policy, its support for Israel, and keen constituent interest. It is especially concerned about U.S. financial and other commitments to the parties, and the 110th Congress is engaged in these matters. Congress also has endorsed Jerusalem as the undivided capital of Israel, although U.S. Administrations have consistently maintained that the fate of the city is the subject of final status negotiations. This CRS report will be updated as developments warrant.
