Don't get me wrong, I'm not condoning his actions, but I have a sinking feeling that he is actually going to get off scot free.

But guilt, in cases of rape, has to be proven beyond all reasonable doubt, and the complainant conceded that he could have interpreted her submission / freezing as consent. So... there is reasonable doubt. He'll get away with it.
